ENTENTE CONCERNANT UNE RENONCIATION, UNE QUITTANCE ET L’ACCEPTATION DES RISQUES

La société 9366-3151 Québec inc., faisant affaires sous le nom de F3 Sports (Québec) inc. (connue sous le nom « iSaute ») fait affaires au Québec en offrant des services de divertissement, notamment des activités en trampoline, tels que des sauts sur trampoline, du ballon chasseur sur trampoline, le basket sur trampoline, des sauts en hauteur, des cours de conditionnement physique, des centres gonflables de loisir et des camps de jour (les « Activités »).

En signant cette Entente, je reconnais et j’accepte que les Activités offertes par iSaute comportent des risques connus et inconnus qui peuvent causer des blessures importantes ou le décès. Sans y être limités, ces risques peuvent être constitués par des ressorts, des crochets, des cadres et/ou d’autres pièces d’équipement exposées, un faible éclairage, un manque de surveillance, et/ou l’absence de pareurs formés, l’absence de rembourrage de protection, de matelas, de filets, et/ou d’autres pièces d’équipement appropriées, l’absence de toute autre mesure adéquate de sécurité, le fait de glisser et/ou de tomber sur ou en bas de l’équipement, le fait de heurter des objets fixes et/ou des personnes, des tentatives de faire des sauts, le fait de courir, le fait de faire des acrobaties, des pirouettes, des culbutes et/ou des manœuvres quelconques, la participation de plusieurs personnes à des Activités en même temps, la condition physique, l’entrainement et/ou toutes autres conditions environnementales, la différence de poids entre les participants, la météo et/ou autres conditions environnementales, et des gestes ou des omissions que le soussigné ou l’enfant pour lequel j’ai la garde légale posent (désigné comme « l’Enfant Mineur »).

En signant cette Entente, je reconnais et j’accepte les risques connus ou inconnus qui peuvent découler de l’utilisation de l’équipement d’iSaute ou découlant de ma participation ou de celle de l’Enfant Mineur aux Activités, et j’accepte que ces risques fassent partie intégrante de la pratique de ces Activités.

En signant cette Entente, je reconnais et j’accepte que moi-même et/ou l’Enfant Mineur participe(nt) librement aux Activités, étant pleinement conscient des dangers et des risques potentiels découlant de la pratique des Activités. Je conviens de visionner la vidéo de sécurité avant de participer aux Activités et de respecter toutes les règles et tous les règlements.

Lorsque l’Enfant Mineur utilise l’équipement d’iSaute ou participe aux Activités, je reconnais qu’iSaute n’est aucunement responsable de sa surveillance et la responsabilité de le surveiller m’incombe en tant que parent ou personne ayant sa garde légale.

Lorsque le soussigné ou l’Enfant Mineur fait (font) usage de l’équipement d’iSaute ou participe(nt) aux Activités d’iSaute, ou lorsque le soussigné ou l’Enfant Mineur à l’égard de qui j’exerce l’autorité légale, est (sont) physiquement présent(s) sur la propriété d’iSaute, je reconnais et j’accepte que des photos et/ou des vidéos (connues comme étant des séquences photographiques) peuvent être prises par iSaute du soussigné ou de l’Enfant Mineur, sans compensation par iSaute ou par ses employés, ses représentants, ses mandataires, ou par toute personne dont les services sont retenus par iSaute. Je cède par les présentes tous mes droits en rapport avec les séquences photographiques, y compris mes droits moraux, en faveur des bénéficiaires, leurs représentants, leurs mandataires, leurs affiliés, leurs clients et leurs ayants droit, sans limiter la généralité de ce qui précède, et j’autorise lesdits bénéficiaires à archiver, à modifier, à corriger et à rassembler pour les fins des actualités, des fins éditoriales, ou publicitaires ou pour toutes autres fins sur Internet ou sur tous autres médias. En conséquence, je cède à iSaute le droit d’utiliser mon image ou celle de l’Enfant Mineur dans ses publications, sur son site internet, dans le cadre de ses promotions ou de sa commercialisation, ou dans tout autre media, soit numérique, imprimé ou autre, sans paiement ou compensation et sans devoir obtenir une autre approbation ou un autre consentement et je cède tous mes droits en rapport avec les séquences photographiques à iSaute.

LE SOUSSIGNÉ RECONNAIT ET CONVIENT QUE LORSQUE LUI ET LES ENFANTS MINEURS PARTICIPERONT AUX ACTIVITÉS ET UTILISERONT LES LIEUX ET LES INSTALLATIONS, ILS LE FERONT D’UNE MANIÈRE RESPONSABLE EN PRENANT DES PRÉCAUTIONS RAISONNABLES ET APPROPRIÉES AFIN D’ÉVITER DE SUBIR DES BLESSURES PHYSIQUES ET DE CAUSER DES BLESSURES PHYSIQUES AUX AUTRES PERSONNES ET D’ENDOMMAGER L’ÉQUIPEMENT. 

LE SOUSSIGNÉ RECONNAIT ET CONVIENT QUE LUI ET LE OU LES ENFANT(S) MINEUR(S) PARTICIPE(NT) DE LEUR PLEIN GRÉ ET À LEURS PROPRES RISQUES. BIEN QUE LA TRAMPOLINE ET LES AUTRES ACTIVITÉS SE DÉROULANT CHEZ ISAUTE SOIENT GÉNÉRALEMENT SUPERVISÉES PAR LES EMPLOYÉS D’ISAUTE, LE SOUSSIGNÉ CONVIENS ET RECONNAIT QU’IL N’EST PAS RAISONNABLE DE S’ATTENDRE À CE QUE SES EMPLOYÉS SURVEILLENT LES ACTIVITÉS ET LES GESTES DE TOUS LES CLIENTS EN TOUT TEMPS. EN OUTRE, LE SOUSSIGNÉ COMPREND QUE L’ÉQUIPEMENT CHEZ ISAUTE PEUT AVOIR DES DÉFAUTS INCONNUS ET IL ACCEPTE CE RISQUE DE SON PLEIN GRÉ. L’ÉQUIPEMENT UTILISÉ DANS LES TRAMPOLINES OU AUTRES APPAREILS OU LORS DES AUTRES ACTIVITÉS, PEUT SE BRISER, AVOIR UNE DÉFAILLANCE OU MAL FONCTIONNER MALGRÉ UN ENTRETIEN ET UNE UTILISATION RAISONNABLES. IL EST POSSIBLE QUE DE L’ÉQUIPEMENT UTILISÉ LORS DES ACTIVITÉS PUISSE CAUSER DES BLESSURES IMPORTANTES OU LA MORT, MÊME LORSQU’IL EST UTILISÉ D’UNE MANIÈRE CONFORME. IL EST POSSIBLE QUE DES PERSONNES FAISANT USAGE DE L’ÉQUIPEMENT PUISSENT PERDRE LE CONTRÔLE DE L’ÉQUIPEMENT, SUBISSANT AINSI DES BLESSURES IMPORTANTES ET EN CAUSANT DES BLESSURES À D’AUTRES PERSONNES. JE COMPRENDS QU’IL EST IMPOSSIBLE D’ÉLIMINER COMPLÈTEMENT CES RISQUES SANS ATTÉNUER LA NATURE MÊME DE L’ACTIVITÉ. EN SIGNANT CETTE ENTENTE, J’ASSUME LA PLEINE RESPONSABILITÉ POUR MES FAITS ET GESTES, POUR MA SANTÉ ET POUR MES RESTRICTIONS PHYSIQUES, AINSI QUE POUR LES FAITS ET GESTES ET LES RESTRICTIONS PHYSIQUES DES ENFANTS MINEURS SOUS MA RESPONSABILITÉ. JE RECONNAIS ET JE CONVIENS QUE LES FAITS ET GESTES OU LES ACTIVITÉS DES AUTRES CLIENTS PEUVENT ME CAUSER DES BLESSURES PHYSIQUES IMPORTANTES, AINSI QU’AUX ENFANTS MINEURS (TEL QUE DÉCRIT CI-DESSUS), ET QU’ISAUTE N’EST AUCUNEMENT RESPONSABLE DES FAITS ET GESTES OU DES ACTIVITÉS DES AUTRES CLIENTS QUI UTILISENT ISAUTE, Y COMPRIS DES ACTIONS, DES ACTIVITÉS OU DES OMISSIONS QUI ONT POUR CONSÉQUENCE LESDITES BLESSURES OU LA MORT.

Je reconnais qu’iSaute peut en tout temps effectuer des promotions qui comportent l’utilisation d’un éclairage tamisé, modifié ou théâtral, et des effets spéciaux, ce qui peut avoir pour effet d’augmenter les dangers et les risques inhérents et manifestes, ainsi que des dangers que l’activité peut représenter pour les participants et les observateurs. Ces risques accrus peuvent causer des blessures physiques ou des séquelles émotives, de la paralysie, la mort, ou des dommages au soussigné, aux Enfants Mineurs et/ou à des tierces parties, ainsi que des dommages aux biens personnels d’une ou de plusieurs de ces personnes. Je comprends que des règles spéciales s’appliquent à la participation et à l’observation de ces activités et que le soussigné et les Enfants Mineurs peuvent ne pas participer à ces activités ni les observer. LE SOUSSIGNÉ RECONNAIT QUE LUI ET LES ENFANTS MINEURS PEUVENT PARTICIPER À CES ACTIVITÉS OU LES OBSERVER DE LEUR PLEIN GRÉ ET STRICTEMENT À LEURS PROPRES RISQUES.

LA RESPONSABILITÉ DE VOTRE SÉCURITÉ VOUS INCOMBE : LE SOUSSIGNÉ ET CHACUN DES ENFANTS MINEURS CONVIENNENT DE RESPECTER LES RÈGLES :

1.      Vous reconnaissez qu’il existe des risques inhérents lors de l’utilisation d’un trampoline et que ces risques ne découlent pas uniquement de l’utilisation du trampoline, mais également des autres activités et d’autres pièces d’équipement. Les clients qui utilisent un trampoline, ceux qui participent à d’autres activités ou qui utilisent d’autres pièces d’équipement acceptent les risques découlant de cette participation. Toute personne normalement prudente doit connaître lesdits risques. Les clients doivent faire preuve d’un bon jugement et ils doivent agir d’une manière responsable lorsqu’ils font usage du trampoline et des autres appareils. Les clients doivent respecter les avertissements oraux ou écrits ainsi que les vidéos et les images de sécurité avant et pendant leur participation.
2.      Vous ne devez pas participer à une activité sur trampoline ainsi que toute autre activité ou utiliser de l’équipement alors que vous êtes sous l’influence de drogues ou d’alcool.
3.      Vous devez correctement utiliser l’équipement de sécurité fourni concernant le trampoline, les installations, les appareils et tout autre équipement.
4.      Vous NE devez PAS participer à une activité en trampoline ou à toute autre activité ou faire usage d’autres équipements si vous avez une condition médicale préexistante, des problèmes circulatoires, des problèmes cardiaques ou pulmonaires, des chirurgies récentes, des problèmes de dos ou de cou, des problèmes de genou ou de chevilles, de la surtension artérielle, si vous êtes enceinte, si vous avez un historique de lésions rachidiennes, de blessures musculosquelettiques ou de blessures à la tête ou si vous êtes enceinte. Vous devez signaler ces problèmes de santé à un employé iSaute avant d’accéder au trampoline.
5.      Vous devez retirer des vêtements et accessoires inappropriés, y compris des objets rigides, aiguisés, pointus ou dangereux, tels que des boucles, des stylos, des sacoches, des épinglettes, etc.
6.      Vous devez éviter tout contact physique avec d’autres clients.
7.      Vous devez respecter les restrictions imposées par iSaute concernant la taille, le poids corporel ou l’âge pour participer à une activité en trampoline, avec d’autres appareils ou autrement.
8.      Vous devez éviter de surcharger les installations de trampoline ou les autres appareils.
9.      Vous devez faire usage du trampoline et des autres appareils selon vos propres limites, formations et habiletés acquises.
10.      Vous devez éviter d’atterrir sur votre tête ou cou. Des blessures importantes, la paralysie ou la mort peuvent se produire lorsque vous atterrissez sur un trampoline ou ailleurs, que le trampoline soit en cause ou un autre appareil.
11.      Vous convenez de respecter tous les avertissements donnés et affichés, ainsi que la signalisation.
12.      Vous convenez de lire, de comprendre et d’expliquer toutes les exigences et les règles de sécurité à chaque Enfant Mineur que vous accompagnez et de vous assurer que chaque Enfant Mineur respecte les exigences et les règles de sécurité.
13.      Vous devez surveiller attentivement chaque Enfant Mineur que vous accompagnez pour vous assurer qu’il se comporte d’une manière sécuritaire en tout temps.
    

Je reconnais que la durée de cette Entente est perpétuelle et qu’elle aura plein effet juridique à chaque fois que le soussigné et/ou l’Enfant Mineur visitent les installations d’iSaute, soit à l’emplacement actuel ou à tout autre emplacement.

WAIVER, GENERAL RELEASE, AND ASSUMPTION OF RISK AGREEMENT

9366-3151 Quebec Inc., doing business under the name F3 Sports (Quebec) Inc. (known as « iSaute ») is a business operating in Quebec and offering entertainment services, more particularly in trampoline activities such as trampoline jumps, trampoline dodgeball, trampoline basket-ball, aerial jumps, fitness classes, bouncing house and day camps («Activities»).

By signing this Agreement, I acknowledge and accept that the Activities offered by and available at iSaute entail both known and unknown risks that could result in serious injury or death. These risks may be due to, but not limited to, exposed springs, hooks, frames, and/or other pieces of equipment; poor lighting; lack of supervision and/or trained spotters; lack of protective padding, mats, netting, and/or other proper equipment; lack of any other proper safety measure; slipping and/or falling on and/or off equipment; collision with fixed objects and/or people; attempted jumps, runs, stunts, tumbles, somersaults, maneuvers and/or acrobatics; having multiple participants participate in the Activities at one time; the physical condition, fitness, and/or abilities of participants; weight differences between participants; weather and/or all other environmental conditions; actions and/or omissions committed by me or the child for which I act as a legal guardian (known as «Minor Child»).

By signing this Agreement, I acknowledge and accept both the known and unknown risks that may occur due to the use of the equipment of iSaute or from my participation or that of the Minor Child to the Activities and accept that these risks are inherent to the practice or performance of these Activities.

By signing this Agreement, I accept and acknowledge that I and/or the Minor Child participate in the Activities freely, fully aware of the dangers and potential risks involved in the practice or performance of the Activities. I agree to watch the safety video before participating in Activities and to respect all rules and regulations.

In the event of using the iSaute equipment or participation to the Activities by the Minor Child, I acknowledge that iSaute is in no way responsible for any monitoring or supervision whatsoever and that it is my responsibility as the parent or person having legal authority to do so.

In the course of using the equipment of iSaute, or of my participation or the one of the Minor Child to the Activities of iSaute, or of my presence or the one of the Minor Child for whom I have legal authority on the premises of iSaute, I acknowledge and accept that shots, photographs and/or videos (known as Footage) be taken of myself or the one of the Minor Child without any form of payment/compensation by iSaute any of its employees, representatives, agents, or any person whose services are retained by iSaute through their representatives. I hereby assign all rights pursuant to any of the Footage, including moral rights, to the beneficiaries, their representatives, agents, affiliates, clients, and assigns, without limiting the generality of the foregoing and authorize the beneficiaries to archive, modify, edit, and join for news, editorial or advertising purposes, or for any other purpose on the Internet or any other media. Consequently, I assign the rights to iSaute to use my likeness and image or that of the Minor Child in its publications on its website in promotional and marketing tools or in any other media, whether it be digital, printed, or otherwise without any form of payment or compensation or need for any other approval or consent and I release all rights to iSaute pertaining to the said Footage.

I ACKNOWLEDGE AND AGREE THAT I AND THE CHILD(REN), BY PARTICIPATING IN THE ACTIVITIES AND USE OF THE PREMISES AND FACILITIES, AGREE TO DO SO IN A RESPONSIBLE MANNER, TAKING REASONABLE AND APPROPRIATE PRE-CAUTIONS TO AVOID PHYSICAL HARMS TO OURSELVES, TO OTHER INDIVIDUALS, AND TO THE EQUIPMENT. 

I ACKNOWLEDGE AND AGREE THAT I AND THE CHILD(REN) ARE PARTICIPATING VOLUNTARILY AT OUR OWN RISK.  WHILE THE TRAMPOLINE AND OTHER ACTIVITIES THAT TAKE PLACE AT ISAUTE ARE MONITORED GENERALLY BY ISAUTE EMPLOYEES, I ACKNOWLEDGE AND AGREE THAT IT IS NOT REASONABLE TO EXPECT SUCH EMPLOYEES TO MONITOR THE ACTIVITIES AND ACTIONS OF ALL CUSTOMERS AT ALL TIMES. FURTHER, I UNDERSTAND THAT THE EQUIPMENT AT ISAUTE COULD SUFFER FROM UNKNOWN DEFECTS, AND I VOLUNTARILY ASSUME ANY SUCH RISK. EQUIPMENT USED IN TRAMPOLINES OR OTHER ACTIVITIES OR APPARATUSES MAY BREAK, FAIL, OR MALFUNCTION DESPITE REASONABLE MAINTENANCE AND USE. SOME OF THE EQUIPMENT USED IN ACTIVITIES MAY INFLICT SERIOUS INJURIES OR DEATH EVEN WHEN USED AS INTENDED. PERSONS USING EQUIPMENT MAY LOSE CONTROL OF SUCH EQUIPMENT AND CAUSE SERIOUS INJURY TO THEMSELVES AND TO OTHERS. I UNDERSTAND THAT SUCH RISKS SIMPLY CANNOT BE COMPLETELY ELIMINATED WITHOUT JEOPARDIZING THE ESSENTIAL QUALITIES OF THE ACTIVITY. BY SIGNING THIS AGREEMENT, I TAKE FULL RESPONSIBILITY FOR MY OWN ACTIONS AND HEALTH, PHYSICAL LIMITATIONS, ALONG WITH THE ACTIONS AND HEALTH AND PHYSICAL LIMITATIONS OF THE CHILD(REN) IN MY CARE.  I ACKNOWLEDGE AND AGREE THAT THE ACTIONS OR ACTIVITIES OF OTHER CUSTOMERS COULD CAUSE ME OR THE CHILD(REN) SIGNIFICANT BODILY INJURY (AS DESCRIBED ABOVE), AND THAT ISAUTE IS NOT RESPONSIBLE FOR THE ACTIONS OR ACTIVITIES OF CUSTOMERS USING ISAUTE, INCLUDING ACTIONS, ACTIVITIES, OR OMISSIONS THAT RESULT IN ANY SUCH HARM OR INJURY OR DEATH.

I acknowledge that the iSaute may, at any time, engage in promotions that involve the use of reduced and altered or theatrical lighting and special effects, which can increase the inherent and obvious risks and dangers of the activity for both participants and observers.  Such increased risks can lead to physical or emotional injury, paralysis, death, or damage to myself, the Child(ren), and/or third parties, and damage to personal property of any or all such persons. I understand that special rules apply to participation in and observation of such activities, and that I and the Child(ren) may choose not to participate in or observe such activities. I ACKNOWLEDGE AND AGREE THAT I AND THE CHILD(REN) MAY VOLUNTARILY PARTICIPATE IN OR OBSERVE SUCH ACTIVITIES SOLELY AND EXCLUSIVELY AT OUR OWN RISK.

SAFETY IS YOUR RESPONSIBILITY: I AND EACH CHILD AGREE TO FOLLOW THE RULES:

1.      You acknowledge that there are inherent risks in the participation in or on any trampoline court, and that such risks include not only the use of trampolines, but other activities and equipment.  Patrons of a trampoline court who use trampolines, and those who engage in any other activities or use any other equipment, by participation, accept the risks inherent in such participation of which the ordinary prudent person is or should be aware.  Patrons have a duty to exercise good judgment and act in a responsible manner while using the trampoline court and other equipment, and while engaging in such activities. Patrons have a duty to obey all oral or written warnings and safety videos and images prior to or during participation, or both.
2.      You have a duty to not participate in any activity on any trampoline court, or engage in any other activity or use any other equipment, when under the influence of drugs or alcohol.
3.      You have a duty to properly use all safety equipment provided, whether for the trampolines at the trampoline court, other equipment, or otherwise.
4.      You have a duty to NOT participate in any activity on any trampoline court, or engage in other activities or use other equipment, if you have pre-existing medical conditions, circulatory conditions, heart or lung conditions, recent surgeries, back or neck conditions, knee or ankle conditions, high blood pressure, known pregnancy, any history of spine, musculoskeletal or head injuries, or if you may be pregnant, and you must report such condition to an iSaute employee before entering the trampoline court .
5.      You have a duty to remove inappropriate attire including hard, sharp or dangerous objects such as buckles, pens, purses, badges, and so forth.
6.      You have a duty to avoid bodily contact with other patrons.
7.      You have a duty to conform with or meet height, weight, or age restrictions imposed by iSaute to use or participate in any trampoline park activity, whether involving the use of trampolines, other equipment, or otherwise.
8.      You have a duty to avoid crowding or overloading individual sections of the trampoline court, or other equipment.
9.      You have a duty to use the trampoline court, and other equipment, within your own limitations, training, and acquired skills.
10.      You have a duty to avoid landing on the head or neck.  Serious injuries, paralysis, or death can occur when landing on the trampoline court bed, or elsewhere, whether involving the trampoline, other equipment, or otherwise.
11.      You also agree to follow and obey all posted and stated warnings and patron education signs.
12.      You agree to read, understand, and explain all requirements and safety rules to each Child you accompany, and to ensure that each Child obeys the requirements and safety rules.
13.      You have a duty to carefully monitor and supervise each Child you accompany to ensure that they are acting in a safe manner at all times.

I understand that this Agreement extends forever into the future and will have full force and legal effect each and every time I and/or the Minor Child visit iSaute, whether at the current location or any other location or facility.
